We also process personal data that we have lawfully obtained and are permitted to process from publicly accessible sources (e.g., commercial registers, press, media, internet). Relevant personal data may include: name, address, and other contact details (telephone, email address), and your company's tax identification number. When selling products/services, additional personal data may be collected, processed, and stored.
3. What do we process your data for (purpose of processing) and on what legal basis?
We process the aforementioned personal data in accordance with the provisions of the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG):
a. To fulfill contractual obligations (Article 6 (1)(b) GDPR)
Personal data is processed for the provision of services and the supply of goods within the context of the performance of our contracts with our customers or for the implementation of pre-contractual measures.
b. Due to legal requirements (Article 6 (1)(c) GDPR) or in the public interest (Article 6 (1)(e) GDPR)
This may include legal reporting obligations.
c. Within the context of the balancing of interests (Article 6 (1)(f) GDPR)
Where necessary, we process your data beyond the actual fulfillment of the contract to protect our legitimate interests or those of third parties.
Examples:
- Assertion of legal claims and defense in legal disputes
- Ensuring IT security and IT operations
d. Based on your consent (Article 6 (1)(a) GDPR)
If you have given us your consent to process your personal data for specific purposes, the lawfulness of this processing is based on your consent. You can withdraw your consent at any time. This also applies to the withdrawal of declarations of consent that were given to us before the EU General Data Protection Regulation (GDPR) came into effect, i.e., before May 25, 2018. Please note that the withdrawal is only effective for the future and processing carried out before then remains unaffected.
4. Who receives my data?
Within our company, access to your personal data is granted only to those departments that require it to fulfill our contractual and legal obligations. Service providers and agents we employ may also receive personal data for these purposes, provided they comply with applicable data protection regulations. We may only disclose your personal information if required by law or contract, if you have given your consent, and/or if data processors commissioned by us guarantee compliance with the EU General Data Protection Regulation (GDPR) and/or the German Federal Data Protection Act (BDSG).
5. Will data be transferred to a third country or an international organization?
Personal data is only transferred to entities in countries outside the EU or the EEA (so-called third countries) if this is legally required for the execution of the customer's orders (e.g., tax reporting obligations), if you have given us your consent, or within the context of order data processing. If service providers in third countries are used, they are obligated to comply with the European data protection level through the agreement of the EU Standard Contractual Clauses, in addition to written instructions.
6. How long will my data be stored?
We process and store your personal data for as long as it is necessary to maintain the contractual or business relationship and to fulfill contractual and legal obligations. If the data is no longer required for the fulfillment of contractual or legal obligations, it is routinely deleted, unless its (temporary) further processing is necessary for the following purposes: compliance with commercial and tax law retention periods and the preservation of evidence within the framework of the statute of limitations.
7. What data protection rights do I have?
Every data subject has the right to information under Article 15 GDPR, the right to rectification under Article 16 GDPR, the right to erasure under Article 17 GDPR, the right to restriction of processing under Article 18 GDPR, the right to object under Article 21 GDPR, and the right to data portability under Article 20 GDPR. The right to information and the right to erasure are subject to the limitations set out in §§ 34 and 35 of the German Federal Data Protection Act (BDSG). Furthermore, you have the right to lodge a complaint with a data protection supervisory authority (Article 77 GDPR in conjunction with § 19 BDSG). You may withdraw your consent to the processing of your personal data at any time. This also applies to the withdrawal of declarations of consent that were given to us before the GDPR came into effect, i.e., before May 25, 2018. Please note that the withdrawal of consent is only effective for the future. Processing that took place before the withdrawal remains unaffected.
8. Am I obligated to provide data?
As part of our business relationship with the legal entity you represent, you must provide us with the personal data necessary for establishing and maintaining a business relationship and fulfilling the associated contractual obligations, or which we are legally obligated to collect. Without this data, business transactions may regularly become impossible.
