2. Which sources and data do we use

We process personal data that we receive from you in your capacity as a prospective customer and/or customer. We also process personal data that we have legitimately obtained and are permitted to process from publicly accessible sources (e.g., commercial registers, press, media, internet). Relevant personal data may include: name, address, and other contact details (telephone, email address), and your company's tax identification number. When selling products/services, additional personal data may be collected, processed, and stored in addition to the aforementioned data.

3. What do we process your data for (purpose of processing) and on what legal basis

We process the aforementioned personal data in accordance with the provisions of the EU General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG):
a. To fulfill contractual obligations (Article 6 (1) (b) GDPR)
Personal data is processed to provide services and supply goods within the framework of the execution of our contracts with our customers or to carry out pre-contractual measures.
b. Due to legal requirements (Article 6 (1) (c) GDPR) or in the public interest (Article 6 (1) (e) GDPR)
This may include statutory reporting obligations.
c. Within the framework of the balancing of interests (Article 6 (1) (f) GDPR)
If necessary, we will process your data beyond the actual fulfillment of the contract to protect our legitimate interests or those of third parties.
Examples:
- Assertion of legal claims and defense in legal disputes
- Ensuring IT security and IT operations
d. Based on your consent (Article 6 (1) (a) GDPR)
If you have given us your consent to process personal data for specific purposes, the legality of this processing is based on your consent. You can revoke your consent at any time. This also applies to the revocation of declarations of consent given to us before the EU General Data Protection Regulation came into force, i.e., before May 25, 2018. Please note that the revocation only takes effect for the future and does not affect processing operations carried out up to that point.

4. Who gets my data

Within our company, those departments that need your personal data to fulfill our contractual and legal obligations will have access to your personal data. Service providers and vicarious agents employed by us may also receive personal data for these purposes if they comply with the statutory data protection regulations. We may only share personal information about you if legal or contractual provisions require this, you have given your consent, and/or the data processors commissioned by us guarantee compliance with the requirements of the EU General Data Protection Regulation/the German Federal Data Protection Act (GDPR/BDSG).

5. If data is transferred to a third country or to an international organization

Personal data will only be transferred to locations in countries outside the EU or the EEA (so-called third countries) if this is required by law to execute the customer's orders (e.g., tax reporting obligations), if you have given us your consent, or if this is part of contract data processing. If service providers are used in third countries, they are obligated to comply with European data protection standards by agreeing to the EU standard contractual clauses, in addition to written instructions.

6. How long will my data be stored

We process and store your personal data for as long as necessary to maintain the contractual or business relationship and to fulfill contractual and legal obligations. If the data is no longer required to fulfill contractual or legal obligations, it will be regularly deleted, unless its (temporary) further processing is necessary for the following purposes: compliance with commercial and tax retention periods and the preservation of evidence within the framework of limitation periods.

7. What data protection rights do I have

Every data subject has the right to information pursuant to Article 15 GDPR, the right to rectification pursuant to Article 16 GDPR, the right to erasure pursuant to Article 17 GDPR, the right to restriction of processing pursuant to Article 18 GDPR, the right to object pursuant to Article 21 GDPR and the right to data portability pursuant to Article 20 GDPR. The restrictions pursuant to Sections 34 and 35 BDSG apply to the right to information and the right to erasure. In addition, there is the right to lodge a complaint with a data protection supervisory authority (Article 77 GDPR in conjunction with Section 19 BDSG). You can revoke your consent to the processing of personal data at any time. This also applies to the revocation of declarations of consent given to us before the General Data Protection Regulation came into force, i.e. before May 25, 2018. Please note that the revocation only takes effect for the future. Processing that took place before the revocation is not affected.

8. Am I obliged to provide data

As part of our business relationship with the legal entity you represent, you must provide us with the personal data necessary to establish and conduct a business relationship and fulfill the associated contractual obligations, or which we are legally obligated to collect. Without this data, business transactions may generally become impossible.
